As the sponsoring minister, the Secretary of State confirmed that the primary objective is to evaluate how the commission approaches governance and decision-making for public parade applications and associated protests. This assessment aims to determine whether current processes are evidence-based, procedurally fair, and legally robust.

The review will specifically examine guidelines, procedural rules, and the code of conduct governing the commission's work. It seeks to identify any shortcomings within the framework that may have contributed to a loss of public confidence.

Public trust has been affected by judicial review proceedings which recently quashed the Parades Commission's determination concerning Portadown District Local Electoral Organisation number one's application for their annual Drumcree parade.

The examination will be conducted by a current or former High Court judge. Sir John O'Hara KC is expected to produce a final report submitted to both the Secretary of State and the chair of the Parades Commission.

The review team will offer actionable recommendations designed to strengthen the legal soundness of future decisions. However, the scope explicitly excludes any judgment on whether permission should or should not have been granted for specific parades.

The inquiry also has no remit regarding the appointment of commissioners. The focus remains strictly on improving the procedures used to make determinations and impose conditions on sensitive events.
